Due to many violations of the UBC Constitution and LMRDA Violations the Local 370 Election will be challenged. We filed the challenge even before the first lever was pulled with Frank Spencer who in his foolish wisdom has chosen to ignore us. We will now bypass the UBC and go right to the DOL for LMRDA violations.

The nod goes to Hotaling with the caveat that Weir is gone..

We had hoped to do interviews and post them but we have not had much cooperation form Candidates .We will keep trying but are running out of time.

The key here is trust. Joe Lynch it appears has come a long way in the eyes of Weir and his bunch from the “Im Crazy” Joe Lynch we have all been subjected to on the job site. I dont know Lynch that well and have never had issue with him. However I have seen his act at meetings where he likes to ridicule and harass the members he now wants to represent. I have also confirmed that as a trial committee member his demeanor is that of a common punk and he has verbally abused members coming to trial. William Weir has been informed of this behavior and refuses to investigate. Also like Lezette he is part of a trial Committee that violates the constitutional rights of members on trial. I find it hard to believe that we need another Officer of Local 370 who thinks the members are here to serve him.

Do not support: It seems that judging by Lynchs behavior towards other members he does NOT belong as a trustee or any other position in this Local. In regards to members that disagree with mandatory participation has been quoted as saying? Lets throw them all out of the Local” We do not need this kind of stupidity anymore. The thing is that the MAJORITY of members disagree with mandatory participation in its present form. As Trustee Lynch has a duty to abide by the majority which is something he appears not to respect. I like many members found it amusing that this person is even running let alone be listed on the Weir slate. This association makes Lynch suspect to begin with.Kind of risky attaching your name to a sinking ship Joe.

The issue has been raised regarding Fair Play and clean elections. But what is fair play. While I am all for chastising two jerks being jerks how far do we allow the potential Union Elects to hide their Dirty Laundry in the interest of fair play.
The call for fair play seems to be coming from those that have the most to hide. Instead of discussing the issues and answering for their actions we are deluged with fair election propaganda all with the same message “Do not tell anyone about me”.Do not discuss any of the bad things I have done to the members of my Union .Do not reveal the actions I have taken which might reveal my true character and give the voters an insight into who I really am. Be nice. Ok.Bull… What makes matters worse is after all that hoorah these Fair Play advocates turn around and try to torpedo the opposition.

Lets take for example Union reviews own Charles Lezette. Charles is a member of Local 370 and works very diligently to screw the members of 370. The only thing Charles works harder at is promoting himself. We at 370 are suffering at the hands of the Empire Council and the present administration. Charles Lezette actively works to support these people and the Empire Council at the expense of the members. Charles is now running as for Delegate to the Empire Council.

Watch as the interview is edited to block out any non favorable mention of William Weir,Kevin Hicks or the Empire Council all whom Lezette supports.All, as Mr Avellino is TRYING to tell us, are screwing the members of Local 370. Listen as Mr. Fair Play tries to lead the interview and interject favorable comments for the Council who he hopes to be a part of. Most damaging and revealing of the true Chuck Lezette is the Title he has given to the Interview”Disgruntled Member or Discouraged” This is the catch phrase the UBC uses to label all that oppose them or expose their dirty Laundry. Count how many time Lezette calls Avellino bitter and harboring hate towards his Union. When Avillino tries to defend himself it is edited . Now you know the fair play of Union Reviews own Charles Lezette.Why if you are interviewing a candidate in the interest of fair play would you attempt to put a disgruntled label on him.

So what is fair play and do we have a duty to reveal all we know as FACT about a person so the members can be informed before they vote. Do we, as is done here, stage interviews to label the opposition as Disgruntled and then demand that your be treated fairly in the Election.This interview and its edit is a blatant attempt to discredit an opposition candidate to further the cause of the Candidate Lezette supports.Is this Fair Play

Do not let them make you a Solwolski Blue Tab illegally. Due to a scam the Council pulled during the last election members were denied the right to vote. RUMORS ,and I do mean RUMORS, are spreading that Mr. Weir will attempt to make up for his lack of voting support by illegally denying members the right to vote. The RUMOR mill has said that it will be the position of the present administration that a member must be a member in good standing for 12 months before the election to be eligible to vote. This is the same scam they pulled on me last election. When I challenged it one of the great minds on the election committee said. ” They wrote the Constitution so they should know if you can vote or not.” After they denied me the right to vote they decided it was because I had payed my dues one day late passed 6 months( I was living out of the country at the time and had sent someone in to pay for me) so I was not eligible to vote. Funny how it was one day.

First may I say that it seems the only one qualified to make official interpretations of the Constitution is Brian Quinn paid legal Beagle for the International. The International VPs such as Frank Spencer it appears have limited knowledge on the Constitution and defer all questions to Mr. Quinn who in turn refuses to respond. You would think to qualify for a District VP job or supervisor of a Trusteeship the District VPs would be required to have a working knowledge of the Constitution. Mr. Spencer and his side kick Mr Capelli and Mr. Quinn have failed to respond to our fellow UBC Brothers at Local 157 on Constitutional matters. How Mr. Quinn who is a hired lawyer became the designated Constitutional expert is beyond me. For those of you that do not know Mr Quinn he was one of the Legal Beagles who persecuted our fellow UBC Union Brothers in the BC Carpenters in Canada. These Carpenters fought for their Democratic rights within the UBC and won their Freedom from the man who “would be king” Dougy McCarron. They will for ever be known as the Carpenters who “Turned out the Lights at the UBC” One has to wonder how Mr. Quinn is recovering form the legal bomb he laid on behalf of the UBC in that legal battle. Mr Quinn although employed by the UBC members has refused to respond to the membership of the UBC. Lets not hold our hand on our ass waiting for the International to defend our right to vote.

We will have to fend for ourselves. Section 42 J CLEARLY outlines the eligibility requirements for voting.” No member of a Union shall be eligible to vote for Officer or Delegates unless such member has been at least 12 Consecutive months a member of the Local Union and is in good standing in the Local Union AT THE TIME OF VOTING” Odd. It does not say anything about in good standing for 12 months prior to the election. We must also be aware that the Observers share the same requirements.. So if you as a member are refused the right to vote based on some BS tell them to stick their Membership Processing System and go pull the lever. You will find that Mr. Weir does nomentor ex maerientand have the voter support so he may try to prevent those that would vote against him from voting.

Update:I have received a letter form the International confirming that members do NOT have to in good standing for 12 months prior to the election. They have to be in good standing at the time of the election

Its Trauma and Long term effects

The one stand out at the Nomination meeting was Mark Sowalski and his book of Blue Tabs. It appears that if in the eyes of Mr Weir and the Member Processing System you were not eligible to be nominated you were marked for denial with a blue tab. Now I am sure this was just for easy reference by Mr Sowalski but did he ever stop to think of the stigma he has now attached to us “less than favorable members”.. Like Al Gore spending the rest of his life living with the fact that he could not beat a brainless border line retarded candidate like George Bush.Similar to this humiliation I will now have to spend my life knowing I was once a Sowalski “Blue Tab”. I have made this same comparison to brother Newell- v- Weir.

It was hard enough coming to realize that because I had refused to pay dues or assessment by the required 3 months that I was a crippled Union Man not fit to be nominated or hold Union Office. I had never abused the members money and had party time at the Marco Island Hilton which the members paid for. I had never stood by while the Empire Council stripped the 229 members of their Pension. I had never turned my back while the 229 Brothers were robbed of their health care. I never got room upgrades in Hawaii. I never was investigated by the Feds for my part in the ULLICO scandal. I never took gifts from investment firms or contractors. I never told a single member to go …while I took raise after raise to finance trip after trip to Ballys and the Montauk Yacht Club. I never turned my back leaving the members to explain to the kids why the trip to Disney was canceled because the Empire Council decided to keep my Vacation Check for another few months. I never stood on the podium and told the members lie after lie to run cover for the Empire Councils deceit. I never stood by and gave the Empire Council the right to fire me if I did not do as I was told. Oh. Wait thats covered in lack of IQ. Not lack of character. Had I only known that this is what makes a good Union Officer.

Is it not alarming the UBC Constitution does not make any of this illegal. It Does not make any of this grounds to be not eligible to hold Office. What it does focus on is paying dues and assessment money to be shuffled up to the Council and International. What does it imply when it provides no penalty to the thieves and Carpetbaggers who rob the members. It makes a member not in good standing and less of a member because they did not pay their 84 pieces of silver in the alloted 3 months. The message seems clear to me. You can screw the members all you want. You can Line your pockets with double pensions and ridiculous salaries. As long as you pay your 84 pieces of silver in the alloted 3 months the UBC will forget your name is Judas Iscariot and hold you up as the poster boys of UBC Unionism.

If these are the qualification’s of a good Union Officer in the UBC than you can count me out. I have paid dues and assessments for 19 years. I have never robbed or cheated my Union Brothers. I never stole from their wallets and took food form their family so I could have another paid Holiday and paid golf day. When it comes time to vote remember who has. Remember to that in the eyes of the UBC any member who refuses to ante up his hard earned cash to support to support and finance the theft form the members is not qualified to run for or hold Office. Remember in the eyes of the UBC those that turn their back on the members,take the golf outings to the Westin Resort,eat dinner at the Montauk Yacht Club and sit track side at Sartatoga while the 229 brothers were languishing in Trusteeship and 20 dollars a credited year for Pension are the good and Qualified candidates for Office. Remember that when you pull the lever to vote.

I guess I do not mind being a blue tab after all.
